INSTRUCTIONS



1. This exam is CLOSED book. No materials of any kind may be used to answer any of the questions.

 2. You have two (2) hours to complete: one (1) essay question and 25 multiple choice questions. The suggested time for the essay question is one hour and fifteen minutes and 45 minutes for the multiple choice questions.  However, you may allocate your time as you wish.

3. The essay question is worth 50 points. Each multiple choice question is worth 2 points, for a total of 50 points.

4. Please write your answer to the essay question in the bluebook(s). Please use the computer Scantron form for your answers to the multiple choice questions. Be sure to write your exam number on each bluebook and on the computer Scantron form.

5. Return all materials including the questions, scratch paper and any unused bluebooks at the end of the exam.

6. This exam consists of 18 pages.

Essay Question (50 points) - Criminal Law Final Exam - Fall 2001

Fenton and his wife Miranda agreed to head the west coast activities of a drug cartel to distribute cocaine.  Although Miranda had no contact with Kerman who was in charge of the New York activities, Miranda knew that she and Fenton worked in connection with Kennan.  Fenton and Miranda owned and operated a restaurant in San Francisco which they used as a front to pass through monies and distribute cocaine to dealers throughout the west coast. F enton and Miranda were successful in their businesses and became socially prominent.  Miranda increasingly spent more time on her charity functions than on business.  Meanwhile, Fenton's use of drugs caused him to become disoriented.  Fenton believed aliens spoke to him and were attempting to control his mind.

 Quinn, an undercover agent was assigned to investigate Fenton and Miranda's activities.  Quinn decided to approach Miranda socially and arranged for an introduction through the mayor.  Quinn asked Miranda to arrange a meeting with Fenton.

 When Fenton meets Quinn, Fenton is convinced that Quinn is an alien being planning to kidnap Fenton.  Without warning, Fenton fires several shots at Quinn, killing him.  Miranda tries to stop Fenton but he chokes her.  While Miranda is unconscious, Fenton has forcible sexual intercourse with her. Miranda has a heart attack during the struggle and dies.  During the entire episode, Fenton's employee Zane watched and cheered, "Kill the witch!" Fenton and Zane are later arrested.
