INSTRUCTIONS

1. This is a closed book exam. No materials of any kind may be used to answer any of the questions.

2. You have two (2) hours and 15 minutes to complete: one (1) essay question and 25 multiple choice questions. The suggested time for the essay question is at least one hour. However, you may allocate your time as you wish.

3. The essay question is worth 50 points. Each multiple choice question is worth 2 points, for a total of 50 points.

4. Please type or write your answer to the essay question in the bluebook(s). Please use the ParSCORE form for your answers to the multiple choice questions.

5. Write your
exam number on your exam envelope, all used blue books, at the top of this exam question packet, and on the ParSCORE answer sheet. Do not use your name, student ID number or Social Security Number on any exam materials.

6. At the conclusion of the exam, return all test materials, including blue books, scratch paper, the ParSCORE answer sheet and this exam packet to the envelope and submit it to the proctor.

ESSAY 50 points -Suggested Time: at least 1 hour

For several months, Darren had been under the care of a psychiatrist for anger management therapy because Darren was prone to violent outbursts. Darren believed that racial minority groups were responsible for the demise in American values and morals. Darren's psychiatrist diagnosed barren as a sociopath suffering from "White Rage." Darren despaired that America would never be "pure" until all other racial groups were driven out from the borders of the United States. Darren asked his friend Felicity if she would help him burn down the Federal Building. Felicity thought Darren was joking and answered, "Sure! Why not? And while we're there, let's ask to the speak to the President." Darren opened his van and showed Felicity the supplies he had gathered: several plastic explosives, machine guns, gloves, false identification papers, and airline tickets to Burma, Laos, and the Ivory Coast. Felicity became frightened but felt she had no choice but to go along with Darren's plan.

On the way to the Federal Building, Darren stopped at a gas station. Felicity waited in the car and called 911 on her cell phone. Unfortunately, the cell phone signal was dropped and Felicity was unable to get through to 911. When Darren went into the men's restroom, he found Vicky inside. Vicky had used the men's restroom because the women's restroom was occupied. Darren pushed Vicky and she fell backwards, hitting her head on the corner of the sink. Vicky appeared to be unconscious. Darren had sexual intercourse with her. Vicky was found dead of a cerebral hemorrhage later that afternoon.

At the entrance to the Federal Building, Darren tells Felicity to wait in the van with the motor running. Darren walked into the building with an ordinary briefcase containing several explosives. Carrying a machine gun, Felicity ran after Darren into the building, intending to stop him from any further action.

When Stella, the security guard sees Felicity running in with a machine gun, she started firing at Felicity. Darren thinks Felicity is trying to help him, so Darren fired at Stella. Stella returned Darren's fire, misses Darren, and fatally shoots Boyle, a federal employee.

What crimes should Darren and Felicity be charged with
Is there sufficient evidence to convict? What defenses should they raise?
