CRIMINAL LAW

  1. You have three (3) hours to complete this exam.

 

  1. This is a closed book exam. Students may not use any outside materials or confer with each other during the exam.

 

  1. This exam consists of two parts. Each section is worth 50 points for a total of 100 points. The suggested time for each section is 1 and ˝ hours. You may allocate your time between the two sections as you wish.

 

Part I consists of twenty –five (25) multiple choice questions. Please mark your responses to the multiple choice questions on the separate “ParSCORE TEST FORM” using pen or pencil and following the instructions on that form. If you change your answer, place a clear X through the wrong answer and mark the correct answer. A machine will score the exam and any ambiguities will be counted as a wrong answer.

 

Part II consists of one (1) essay question. The essay answer should demonstrate your knowledge of the law as applied to the facts.  Conclusions without analysis will not receive credit.  The essay answer should discuss the common law, modern variations, and the Model Penal Code, as needed. Please write your response in the blue books provided. Please write clearly. Write on every other line and every other page to permit instructor comments.

 

  1. Write your exam number on your exam envelope. Put your correct class section and student exam # at the top of this page, each page of questions, each blue book, and the ParSCORE TEST FORM. Do not use your name, student ID number or Social Security Number on any exam materials.

 

  1. At the conclusion of the exam, return all test materials, including blue books, ParScore answer sheet, scratch paper, and this exam packet to the envelope and submit it to the proctor. DO NOT seal the envelope. Students who do not return all exam materials at the end of the exam may not be graded.

Essay Question

 

          Anya and Bea were business partners in a male modeling agency called “Fashion Faces.”  The agency was very successful and became known for finding and launching the careers of new and fresh faces.  As part of a new reality television series, Fashion Faces went on the road throughout the United States to search for “America’s Next New Face.” 

 

            In their search for America’s next new face, Anya and Bea interviewed thousands of handsome and beautiful young men.  They often joked that their interviewees made a “nice genetic pool of potential sperm donors.”   Dr. Filler treated Anya for depression and provided her with a large quantity of the "party drug" called gamma hydroxybutyrate (GHB).  After interviewing Leo, a potential model, Anya and Bea invited him to dinner and mixed his drink with a combination of GHB and Viagra.  After Leo lost consciousness, Anya and Bea each had sexual intercourse with Leo.  Anya and Bea froze Leo’s sperm and sold it to Dr. Filler, a fertility specialist. Leo had no recollection of the evening other than his dinner with the ladies. 

 

            Anya and Bea used the GHB to “collect” sperm from another potential model, Marcel.  After drinking the mixture of GHB and Viagra, Marcel had a violent reaction to the drugs and began vomiting.  Anya and Bea quickly drove Marcel to a local hospital.  While the unconscious Marcel waited for medical attention, Dex mistakenly identified Marcel as a rival gang member and stabbed Marcel.  Marcel never regained consciousness and died 13 months later.  Anya and Bea sold Marcel’s sperm to Dr. Filler.

 

            The following month, Anya and Bea interviewed Nash as their next potential model and gave him the mixture of GHB and Viagra.  After Nash lost consciousness, Anya began to have sexual intercourse with him, but Nash began to vomit and choke.  Unbeknownst to Anya and Bea, Nash died during sexual intercourse with Anya.  Anya and Bea drove Nash to the hospital and left him there for medical treatment.  They sold Nash’s sperm to Dr. Filler.

 

            The police investigation into the deaths of Marcel and Nash have led them to Anya, Bea, and Dr. Filler.  Anya and Bea both claim that they did not believe they were committing the crime of rape since they are women.  Medical testing has shown that Anya has an extra female chromosome resulting in a rare condition known as the “Super Female”.  Some medical experts believe that “Super Females” are unable to control their sexual behavior.  Bea claims that she was afraid of Anya and that she was not acting of her own free will.  Dr. Filler claims to have no knowledge of Anya and Bea’s illegal activities.

 

 

 

 

 

           

  1. What crimes, if any, have Anya, Bea, and/or Dr. Filler committed against Leo, Marcel, and Nash? What defenses are likely to be raised?

 

  1. What is the likelihood of obtaining a conviction on any of the crimes charged?

 

  1. If Anya is convicted of any sex crimes, can the State punish her by requiring that she undergo hormone therapy for the rest of her life?
