is worth 5 points. The first essay question is worth 25 points and the second is
worth 30 points.

ESSAY QUESTIONS
Question 1 (25 points)
Your client Knotwell Corp., a large multi-national biotechnology company in California has made a job offer to Dr. Kind, a citizen of the United Kingdom, for an advanced-level position managing its research department in California. Dr. Kind is currently overseeing a major research project at the company's facility in the United Kingdom. Knotwell Corp. wants Dr. Kind to start work at its California facility as soon as possible. He initially will be engaged on a three-year scientific research project, and thereafter the company wants to continue to employ him for an indefinite period on further research projects.
Knotwell Corp. has told you that it is very interested in transferring Dr. Kind, and desires to pursue any and all legal means for hiring him as soon as possible and for employing him on a long-term basis. Please indicate all of the possible strategies you would recommend to achieve Knotwell Corp.'s dual objectives regarding Dr. Kind, and the reasons for your recommendations.
Question 2 (30 points)
Ms. Goh, a Chinese national, has been in H-1B status with Knotwell Corp. since August of 2000 following her receipt of a Master's Degree in Electrical Engineering. She is now a Senior Software Engineer in Knotwell's bio-informatics department. Ms. Goh's supervisor has requested that Human Resources immediately start processing her toward permanent residence. The new Human Resources Manager at Knotwell has no experience in immigration matters, and has therefore asked you to review this matter with her in a telephone conference. Based on this fact situation, please indicate what you will tell the Human Resources Manager.
