One fine Monday afternoon, Dave (D) said to his friend Mike (M), “I was in Ed’s Liquor Store yesterday. Ed (E) has a lot of money in his cash register. Let’s go get it.” Mike said, “Fine.” While Mike went out to Dave’s car, Dave took a pistol from his desk and put it in his pocket. Dave drove them towards Ed’s. When they were about a mile from Ed’s, Dave said, “Hey, I just remembered. Ed’s isn’t open on Mondays.” Mike said, “Damn. Well, let’s get that guy walking down the street instead,” pointing to Vic. Dave stopped the car and handed his pistol to Mike. Mike got out and walked up to Vic. Mike pulled out his pistol, pointed it at Vic, and said, “Give me your wallet.” Vic reached into his pocket, but instead of bringing out a wallet, brought out a gun and fired at Mike, missing him. When Mike saw that Vic was about to fire again, Mike stopped him by firing his own pistol at Vic, hitting him in the shoulder. Mike fled, Vic survived, and Dave was arrested.
Dave has been charged with attempted robbery of Ed and attempted murder of Vic. Is the above evidence sufficient to sustain a conviction on either charge?
