1. You have two (2) hours for this exam. You may allocate your time as you wish.

2. This is a closed book exam.

3. There are 2 parts to this exam:

a) PART 1 is Multiple Choice. This segment is worth about 1/2 of your grade. Correct multiple choice answers are to be marked on the separate “ParSCORE TEST FORM” using pen or pencil and following the instructions on that form. If you change your answer, place a clear X through the wrong answer and mark the correct answer. A machine will score the exam and any ambiguities will be counted as a wrong answer.

b) PART 2 consists of one (1) essay. This segment is worth about 1/2 of your grade.

4. Write your exam number on your exam envelope. Put your correct class section and student exam # at the top of this page, each page of questions, each blue book, and the “ParSCORE TEST FORM.” Do not use your name, student ID number or Social Security Number on any exam materials.

5. Please write clearly. Write on every other page to permit instructor comments.

6. At the conclusion of the exam, return all exam materials to the exam envelope and submit it to the proctor. Do not seal the envelope. Students who do not return all exam materials at the end of the exam will not be graded.

Note: Read facts and questions carefully!

One fine Monday afternoon, Dave (D) said to his friend Mike (M), “I was in Ed’s Liquor Store yesterday. Ed (E) has a lot of money in his cash register. Let’s go get it.” Mike said, “Fine.” While Mike went out to Dave’s car, Dave took a pistol from his desk and put it in his pocket. Dave drove them towards Ed’s. When they were about a mile from Ed’s, Dave said, “Hey, I just remembered. Ed’s isn’t open on Mondays.” Mike said, “Damn. Well, let’s get that guy walking down the street instead,” pointing to Vic. Dave stopped the car and handed his pistol to Mike. Mike got out and walked up to Vic. Mike pulled out his pistol, pointed it at Vic, and said, “Give me your wallet.” Vic reached into his pocket, but instead of bringing out a wallet, brought out a gun and fired at Mike, missing him. When Mike saw that Vic was about to fire again, Mike stopped him by firing his own pistol at Vic, hitting him in the shoulder. Mike fled, Vic survived, and Dave was arrested.

Dave has been charged with attempted robbery of Ed and attempted murder of Vic. Is the above evidence sufficient to sustain a conviction on either charge?
